SMCL Foundation – Donation Terms & Conditions

Effective Date:  03/01/26

By making a donation to the SMCL Foundation, you acknowledge and agree to the following terms and conditions:

1. Acceptance of Donations

All donations, gifts, and contributions made to the SMCL Foundation are accepted at the sole discretion of the organization. The Foundation reserves the right to decline any donation that does not align with its mission, values, or operational capacity.

2. Use of Donations

All contributions will be used to support the mission and programs of the SMCL Foundation. Donations will be directed toward initiatives that promote accessibility, adaptive sports, community development, and support for individuals with disabilities, unless otherwise agreed upon in writing.

3. Donor Financial Responsibility

The SMCL Foundation encourages all donors to make contributions that are appropriate for their financial situation. The Foundation will not knowingly accept any gift that could reasonably compromise a donor’s financial well-being.

4. No Tax or Legal Advice

The SMCL Foundation does not provide legal, financial, or tax advice. Donors are encouraged to consult with their own professional advisors regarding the tax implications or other consequences of their contributions.

5. Types of Acceptable Donations

The SMCL Foundation generally accepts the following types of contributions:

  • Monetary donations (cash, credit/debit, electronic transfer)
  • Publicly traded securities

Other forms of donations, including but not limited to:

  • Real estate
  • Personal property
  • In-kind contributions
  • Non-liquid securities

may be accepted on a case-by-case basis and are subject to review and approval.

6. Review of Non-Standard Gifts

Certain contributions may require additional review prior to acceptance due to potential legal, financial, or operational considerations. This includes gifts with restrictions, unclear sources, or those that may create ongoing obligations for the Foundation.

7. Donation Receipts and Acknowledgment

The SMCL Foundation will provide appropriate acknowledgment for all donations in accordance with applicable laws and regulations.

  • Receipts will be issued for monetary donations.
  • For non-cash contributions, the Foundation will acknowledge receipt but will not assign a monetary value. Donors are responsible for determining the value of such gifts for tax purposes.

8. Refund Policy

All donations are considered final. Refund requests may be considered on a case-by-case basis if submitted within a reasonable timeframe and if the donation was made in error.

9. Donor Privacy

The SMCL Foundation respects the privacy of its donors. Personal information collected during the donation process will be used solely for communication, record-keeping, and legal compliance. The Foundation will not sell, trade, or share donor information with third parties without consent, unless required by law.

10. Restricted Donations

Donors may request that their contributions be used for a specific purpose. While the SMCL Foundation will make reasonable efforts to honor such requests, it reserves the right to reallocate funds if the original purpose becomes impractical, no longer necessary, or inconsistent with the Foundation’s mission.

11. Changes to Terms

The SMCL Foundation reserves the right to update or modify these terms and conditions at any time. Updates will be posted on the organization’s website.
